Risk Tip of the Week:
Heads Up! Discuss Title Insurance for New Homes!
At a recent presentation of the Arizona
Department of Real Estate, a point was made about a problem
with new construction and builders in these challenging
economic times. Scenario: Our Happy Home Buyers
closed on their lovely, newly constructed home. Several
weeks after moving in they are notified of a Mechanic’s Lien
that has been filed on their home. What to Do: Be
sure your client discusses with the title company prior to
closing the advantages of an extended ALTA
Homeowner’s Policy. One advantage is if an extended policy
is in affect and a lien is placed before or after close of
escrow, your client is protected. This risk reduction tip provided by TAR is a general
statement intended to raise important issues relevant to
risk reduction. This tip is not intended to be legal advice.
It should not be a substitute for advice of professional
counsel or the assistance provided by an agent's Designated
Broker.

Explanation of Revisions To CDOM
As part of the continuing mission to be ‘The Voice For Real Estate
In Tucson’, the MLS Board approved adding Cumulative
Days On Market (CDOM) data to the MLS. This move
demonstrated the Board’s commitment to providing
accurate and comprehensive data to its members. When
implemented, the CDOM data was included on the Agent
Detail Report. After much feedback from members, as
well as Sellers, it was realized that the Agent Detail
Report is used by our members as a marketing tool and
the seller does not have the opportunity to approve or
deny use of this information on the Residential Input
Sheet. After many hours and meetings of the Technology
Committee and a CDOM Task Force, considering the
negative impact to the seller, and by extension to the
membership, it was recommended by the TARMLS Technology
Committee to the TARMLS Board of Directors to remove
this information from the Agent Detail Report ONLY. The
Board of Directors unanimously approved the
recommendation. The data still shows on the Active One
Line Grid display, as well as anytime a member searches
the history of a property. The CDOM is always used in
our statistical ‘Sold’ data. This change has taken a
while to have implemented, and the membership was
notified at the time the change was activated.
