IRS
Gets Picky About Who's a Real Estate Professional
The Internal Revenue Service is paying close attention to
the definition of "Real Estate Professional" when it reviews
tax returns. Under the IRS Code and Regulations, real estate
professionals are defined as those who spend 750 hours or
more annually handling real estate-related activities.

Donate Now! School Supplies Drive for TUSD!
Stuff the
Bus for
TUSD! TAR will be hosting a school supplies drive with
the help of Beaudry RV and Office Max. To preserve costs, we
will be “stuffing” an RV, provided by Beaudry RV. Mark your
calendars to drop of your donation on any of the following
dates: July 18, 19, 25 and 26 and August 1 and 2 from Noon
to 3:00 p.m. at Office Max, 5550 E. Broadway or on Friday,
August 1 from 7:00 a.m. to 10:00 a.m. Supplies needed are
anything from pens and pencils to paper and backpacks. If
you’d like to volunteer, please contact Laura at 382-8775.

Call for
Volunteers for the Property Management Committee-Rescheduled
to August 27 A new
Property Management Committee is being formed and we are
seeking interested volunteers. The purpose of the Committee
will be to: 1) educate membership on the standards of
practice and competency reasonably expected in the property
management discipline, 2) educate membership on the
standards of care involved in property management and 3)
make recommendations regarding the Rapattoni MLS system with
respect to rentals. Our next scheduled
meeting that was to be on July 24 from 10:00 – 12:00
is RESCHEDULED for August 27 from 10:00 - 12:00 at the Association office. Should

Scenario: You have decided to sell your own real estate –
whether it is your primary residence, a vacation home, or
investment property. Regardless of whether you are going to
be the listing agent, co-agent, or just simply the seller
with another agent actually taking and submitting the
listing. Or, you are related to the seller of the property
and you are going to be the listing agent or co-agent. And,
for whatever reason, you don’t think about disclosing to the
public that you are a licensed real estate agent.

Lenders
and sellers DO NOT dictate MLS Policy! We are seeing more
violations of MLS rules and a large portion of these are
based upon requests made by the lender and/or seller.
MLS rules are governed by the Board of Directors and all
Participants are required to comply. This means that
Lead Based Paint forms must be complete upon entering a
listing, or the listing will be temporarily withdrawn
until the form is completed. If a listing is under
contract the status MUST change from Active, regardless
of the seller’s wishes or the bank’s requests. If they
wish to continue to receive offers, then the necessary
provisions for Active CAPA need to be written into the
agreement. If the seller does not want a Board approved
keysafe on the property, then the listing must state
Keysafe ‘No’. Short
Sales and REO’s will probably be with us for awhile, and
the MLS system is structured to accommodate these types
of listings without breaking the rules. The best
course of action is to notify the seller or institution
of the rules that may be questioned early in the
process. All violations will be submitted to the
Standards Committee without exception.
REALTOR® Only MLS-Update-Time is
Running Out!
You
have no doubt heard that as of 7/1 we are now a
REALTOR® only MLS. If you have not joined a
REALTOR® Association by August 1st, your MLS privileges will
be suspended. The reason we are doing this is so that
all MLS participants will be subject to the same Code of
Ethics and professional standards process. Just to clarify,
a participant in the MLS must be a REALTOR®. This does
not mean he or she must be a member of the Tucson
Association of REALTORS®. Someone can be a member of
any other REALTOR® Association and still be a member of our
MLS without having to formally join our Association.
Appraiser members do not have to go to real estate school,
as they are already recognized by the National Association
of REALTORS®, they just need to join an Association.
Additionally, there will be one group of people
intentionally exempted from the all REALTOR® MLS and that is
Builders who list their properties in the MLS. Site
sales agents, for example, can input listings without being
REALTORS®. Builders who take advantage of the
exemption will only be able to list property. If they
want to use the full functionality of the MLS for other
activities they will need to join both the Association and
MLS. Current MLS only members who are not REALTORS® may join
the Association of their choice. For those that join the
Tucson Association, they will pay the prorated Association
dues based upon the date they join.
TAR MLS Dues Billing
Information The 2008/2009 MLS fees
invoices have been mailed out. The $230 is due
to MLS on July 31st, 2008. Fees are non-refundable
and cannot be paid in installments. Dues can
always be paid online at
www.tucsonrealtors.org with a major credit
card. Select “Members” link, “Pay MLS Dues
Online,” and follow the login instructions. Fees
may also be paid in person or by mail, with a check or
major credit card. Important Dates:
Invoice Due Date: 7/31/08; $25 Late Fee Assessed:
8/6/08; Suspension of MLS participation for non-payment
of dues 8/16/08 and Termination of MLS participation for
non-payment of dues: 8/26/08. In the event a member is
terminated for non-payment of MLS fees, they are subject
to a $45 MLS application fee, as well as the MLS fees
due at the time of invoice. The member will be
required to take New Member Orientation again.

San Carlos, Mexico
Listings
We have added a link to the San Carlos, Mexico
MLS public site to the Rapattoni MLS. Under
‘Links, Links and Documents’, you will find the
link that will take you to the site. Please be
aware that you must be licensed in the state of
Sonora to practice real estate, and that these
listings are not subject to the rules and
regulations of the Tucson MLS. This is an
excellent referral opportunity to better serve
your clients interested in San Carlos. We are
also working with Rocky Point to get a link to
their listings as well. In the near future, we
will have the Active San Carlos listings
available to search within Rapattoni, and the
Tucson active listings will be available to San
Carlos.
