Risk Tip of the Week:
Short Sale "Agreement Notice"
You are the Short Sale Listing Agent working diligently for
weeks to get the Seller’s creditor(s) to approve the
purchase contract the Buyer and Seller have agreed upon.
Then you finally get it, the approval letter from the first
lien holder. This is the golden ticket you have been waiting
for all this time. Even though the second lien holder has
not sent their approval letter, you quickly send a copy to
the Buyers Agent so they can open escrow and start
inspections per Short Sale addendum. Full Article
This risk reduction tip provided by TAR is a general
statement intended to raise important issues relevant to
risk reduction. This tip is not intended to be legal advice.
It should not be a substitute for advice of professional
counsel or the assistance provided by an agent's Designated
Broker.

Keyboxes In MLS
Per MLS rule, ‘Participant shall not indicate a
property has a Keybox until the approved Keybox has
physically been placed on the property.
Only the approved keybox may be represented in the MLS.’
The only reference to a Keybox that is permitted in
MLS is for the Board approved Keybox. The only Board
approved keybox at this time is the iBox from
GE/Supra. References to ‘combination’ boxes or
‘contractor’ boxes are not allowed. This includes
statements such as ‘call for code’, etc. If there is
no iBox on the listing, the MLS input should be
‘keysafe no’, with no other references to a box,
codes, etc. in the MLS. Violation of this rule is
subject to a minimum fine of $100.00.
Access To Arizona Foreclosure Information!
MLS has entered into an agreement with RealtyTrac that will allow Tucson MLS members to access foreclosure information for the state of Arizona for a discounted rate of only $19.95 per month. There is no minimum term required to sign up. The links to register for this service are located in the MLS under the ‘links’ tab, and there is also a button on the tucsonrealtors.org website.

Agents joining the MLS after
June 1, 2009 must complete MLS Orientation within 90
