News Flash! This Just In-DOJ
Lawsuit Settled! On May 27, 2008, NAR and
the U.S. Department of Justice
reached a favorable settlement,
concluding a two-year DOJ investigation followed by
two and a half years of litigation, regarding NAR's
multiple listing policy as it pertained to the
display of listings from the MLS on brokers' virtual
office Web sites, or VOWs.
What the settlement accomplishes: The
proposed terms (PDF 28K) are a win
for NAR, REALTORS®, and consumers, and confirm that
MLS members must be
actively engaged in real estate brokerage
(PDF 32K) by actually helping people buy or sell
homes. This will ensure that MLSs are used for what
they were originally intended to do — to help real
estate professionals find buyers for people who want
to sell their homes. NAR has also agreed to adopt a
revised
Virtual Office Web site policy (PDF
36K) that NAR will request MLSs to adopt. NAR
settled with the DOJ without financial penalty or
admission of guilt.

TAR MLS Dues
Billing Information The 2008/2009 MLS fees invoice will
be mailed about June 13th, 2008. The $230 is due to MLS
on July 31st, 2008. Fees are non-refundable and can not
be paid in installments. Dues can always be paid on
line with a major credit card. Select “Members” page,
“Pay MLS Dues Online,” and follow the login
instructions. Fees may also be paid in person or by
mail, with a check or major credit card. Important
Dates: Invoice Due Date: 7/31/08; $25 Late Fee Assessed:
8/6/08; Suspension of MLS participation for non-payment
of dues 8/16/08 and Termination of MLS participation for
non-payment of dues: 8/26/08. In the event a member is
terminated for non-payment of MLS fees, they are subject
to a $45 MLS application fee, as well as the MLS fees
due at the time of invoice. The member will be required
to take New Member Orientation again.

New Beginnings for Women and Children Needs Your Financial
Help!
New Beginnings for Women and Children is a nonprofit
organization founded in Tucson in 1987 to help homeless
women and their children become financially independent. New
Beginnings has experienced a significant shortfall of
$150,000 in donations due to current economic conditions. As
a result, they have set up the New
Beginnings Fund and have a goal of raising $50,000 by June
13. The New Beginnings Fund is a campaign to bridge
the gap between their increasing expenses and current income
level. Your support can have a positive impact on
women and children that will last for their entire lives.
To contribute to the fund, make a
donation at any Chase Bank. Online contributions can be made
at
www.nbwcfund.org. Or write a check payable to New
Beginnings with “New Beginnings Fund” written on the memo
line, and mail it to 2590 N. Alvernon Way, Tucson, AZ 85712.

Real Estate EXPO, Are You Ready? Exhibitor and

address with NAR. NAR will be suspending all those who do
not have a
valid e-mail address listed in their profile as July
1, 2008 under a new policy that will take effect. The
policy states an email address will be a required NRDS core
field in the member record.

Risk Tip Of the Week:
RADON: The Invisible Risk
Odorless, colorless, tasteless – completely
invisible, radon gas can be very harmful even at very low
concentrations when exposures (dose) are extended for
significant amounts of time. Therefore, the presence of
radon gas in a residence can potentially be hazardous to the
occupants. Many factors affect the presence and
concentration of radon gas in a home – or any structure for
that matter, and there are also many variables that affect
dose to the residents.

REALTOR® Only MLS-Update
You have
no doubt heard that as of 7/1 we are going to an all
REALTOR® MLS. The reason we are doing this is so
that all MLS participants will be subject to the
same Code of Ethics and grievance process. Just to
clarify, a participant in the MLS must be a
REALTOR®. This does not mean he or she must be a
member of the Tucson Association of REALTORS®.
Someone can be a member of any other REALTOR®
Association and still be a member of our MLS without
having to formally join our Association. Appraiser
members do not have to go to real estate school, as
they are already recognized by the National
Association of REALTORS®, they just need to join an
Association. Additionally, there will be one group
of people intentionally exempted from the all
REALTOR® MLS and that is Builders who list their
properties in the MLS. Site sales agents, for
example, can input listings without being
REALTORS®. Builders who take advantage of the
exemption will only be able to list property. If
they want to use the full functionality of the MLS
for other activities they will need to join both the
Association and MLS. Current MLS only members who are
not REALTORS® may join the Association of their
choice. For those that join the Tucson Association,
they will pay the prorated Association dues based
upon the date they join.
MLS Computer Classes Are NOW Available for Credit!
The following computer technology
classes are being offered for 3 hours of general credit:
Rapattoni Levels 1,2, and 3, Using ZipForm and
Tech-Savvy Real Estate Agent. For more information,

MLS Area Boundaries Revision A subcommittee has been formed to address the MLS map
and boundaries. As the county continues to grow and more
subdivisions are added, it has become necessary to look
at the area boundaries and implement a system that not
only works today, but will be valid as we continue to
grow. If you have inputs on this issue, please forward
them to John Mijac-
john@mijac.info or Brian Case-
brian@tucsonrealtors.org We will update on the
progress of the subcommittee when appropriate.
New Forms Approved
The Association Board of Directors approved a
Listing Contract Checklist and
Sale Contract Checklist. The Checklists are
forms created by the TAR Forms Committee to assist
Brokers/Office Managers in file management. These
forms are for internal company use only and are not
intended to replace a checklist you may already be
using.
